By accessing or using our website or engaging us for Services, you agree to be bound by these Terms.

You agree to use the Wolverine Land Services website only for lawful purposes. You shall not use the website to transmit any material that is unlawful, harmful, threatening, abusive, libelous, or otherwise objectionable.

All content on the website, including text, graphics, logos, images, and project portfolios, is the property of Wolverine Land Services or its content suppliers and is protected by copyright and intellectual property laws. These terms apply to all Services provided by Wolverine Land Services, including landscaping design, landscape construction, and fencing projects. The specific scope of work, timeline, and pricing for each project will be detailed in a separate, formal Service Agreement, Proposal, or Contract ("Contract") that you and the Company will sign. In the event of a conflict between these Terms of Service and a signed Contract, the terms of the signed Contract shall prevail.

• Binding Agreement: All Services are subject to a written Contract executed by both parties.
• Change Orders: Any changes or additions to the approved scope of work, materials, or timeline must be agreed upon in a written Change Order signed by both parties. Change Orders may result in adjustments to the total cost and project completion date.

• Pricing: Pricing is detailed in the Contract. A non-refundable deposit may be required to begin design or secure a construction start date.
• Invoicing: Payment schedules (e.g., progress payments, lump sum, or separate charges for labor and materials) will be specified in the Contract.
• Late Payments: Payments not received by the due date are subject to a late fee, which shall be per month and may be the maximum amount allowed by Texas law.
• Sales Tax: The Client acknowledges that certain landscaping and lawn care services, as well as the materials incorporated into construction and fencing projects, may be subject to Texas Sales and Use Tax. The final amount of any applicable tax will be clearly itemized on the invoice per Texas Comptroller guidelines.

• Access: The Client must provide Wolverine Land Services and its personnel with unimpeded access to the property as reasonably required to perform the Services.
• Pre-Existing Conditions: The Client warrants that the work area is free of any unknown hazards, including unmarked utility lines, irrigation lines, or environmental contaminants. The Client is responsible for any damage to unmarked lines. While the Company will call 811 for utility marking, the Client remains responsible for lines and structures not covered by 811.
• Water/Electric: The Client agrees to provide necessary water and electricity access at the work site for the duration of the project at no cost to the Company.

• Workmanship: Wolverine Land Services warrants that all labor will be performed in a professional and workmanlike manner consistent with industry standards in San Antonio, Texas. This warranty shall be for a period of one (1) year from the date of final project completion.
• Materials: Material warranties (e.g., plants, lumber, hardscape) are typically covered by the manufacturer or supplier and passed through to the Client. The Company makes no additional express warranties on materials beyond its installation quality.
• Plant Material: The Company does not warrant the survival of plant material installed unless the Contract specifically includes a Plant Replacement Guarantee, and then only if the Client adheres to all stipulated care instructions (e.g., watering schedule).
• Disclaimer: EXCEPT AS EXPRESSLY PROVIDED IN THE CONTRACT, WOLVERINE LAND SERVICES DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, the Client agrees to indemnify, defend, and hold harmless Wolverine Land Services, its officers, agents, and employees, from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or resulting from the performance of the Services, BUT ONLY TO THE EXTENT THAT such claims, losses, or expenses are caused by the negligence, breach of contract, or willful misconduct of the Client or its agents.

Wolverine Land Services agrees to indemnify, defend, and hold harmless the Client from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or resulting from the performance of the Services, BUT ONLY TO THE EXTENT THAT such claims, losses, or expenses are caused by the negligence, breach of contract, or willful misconduct of Wolverine Land Services or its employees/subcontractors.

These Terms and any resulting Contract or dispute shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any legal action or proceeding arising under these Terms or the Services shall be brought exclusively in the courts located in Bexar County, San Antonio, Texas.

Either party may terminate the Contract for material breach if the other party fails to remedy the breach within seven (7) days of receiving written notice. In case of termination, the Client shall pay for all Services performed and materials purchased up to the date of termination.

Wolverine Land Services shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to, acts of God, weather events, labor disputes, material shortages, or governmental acts.

If any provision of these Terms is found to be unenforceable or invalid under Texas law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining Terms shall remain in full force and effect.

BY USING OUR WEBSITE OR ENTERING INTO A CONTRACT FOR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
